Change in the law on issuing permits for temporary residence

In Podgorica on December 23rd, 2022, there was a law change that will definitely represent an interesting change for all our future clients. Proof of secured accommodation in Montenegro

When it comes to applying for temporary residence in Montenegro, one of the most important components is, of course, proof of accommodation. Previously, accommodation contracts could be drawn up directly at the agency, but now they must be certified by a notary, and each must have a term of at least one year.

New article of the law on the application of temporary residence

Based on Article 41 paragraph 8, Article 61 paragraph 6, Article 62 paragraph 7, Article 64 paragraph 5, Article 79 paragraph 9, Article 80 paragraph 8 and Article 82 paragraph 6 of the Law on Aliens ("Official Gazette of Montenegro", no. 12/18, 3/19 and 86/22), the Ministry of Internal Affairs passed: RULE ON AMENDMENT OF THE RULE ON FORMS, DETAILED CONDITIONS AND PROCEDURE ISSUING PERMITS FOR TEMPORARY RESIDENCE AND PERMITS FOR TEMPORARY RESIDENCE AND WORK

Article 1

Article 10 of the Rulebook on Forms, Detailed Conditions and Method of Issuing Temporary Residence Permits and Temporary Residence and Work Permits (Official Gazette of Montenegro No. 25/19, 21/20, 37/21 and 120/21) reads as follows: "Evidence of provided accommodation is considered to be:

1) a document on the foreigner's right of ownership of the residential area;
2) a concluded contract on the lease of a residential space, accompanied by a document on the lessor's ownership right on that space;
3) the employer's confirmation of the provided collective accommodation, to which is attached: a document on the employer's property right, or - a concluded lease agreement and a document on the lessor's property right; or
4) confirmation of accommodation with a company or entrepreneur or natural person registered for providing accommodation services.

Proof of secured accommodation for the issuance of a temporary residence permit for the purpose of family reunification with a Montenegrin citizen or a foreigner who has been granted permanent residence shall be considered a written statement of the person with whom the foreigner has secured accommodation, accompanied by:

1) document on the property right of a Montenegrin citizen or a foreigner in housing space; or
2) a concluded contract on the lease of residential space and a document on the lessor's property right in that space."

Article 2

Reasons for applying for temporary residence

A foreigner may be issued a temporary residence permit and a temporary residence and work permit, if:

1) has means of support;
2) has accommodation provided;
3) has health insurance;
4) has a valid foreign travel document or identity card issued to him by the competent authority of another country, the validity period of which must be at least three months longer than the period for which the residence or travel document for a stateless person is approved;
5) he was not banned from entering and staying in Montenegro;
6) in Montenegro, he has not been sentenced to an unconditional prison sentence of more than six months for a criminal offense for which he is being prosecuted ex officio, or the legal consequences of the conviction have ceased;
7) in the country of origin, he has not been sentenced to an unconditional prison sentence of more than six months for a criminal offense for which he is being prosecuted ex officio, or the legal consequences of the conviction have ceased;
8) there are no obstacles for reasons of national or internal security or public health;
9) attach proof of the justification of the request for the issuance of a permit.
